1. Introduction

Welcome to BuggIN Madeira. These Terms and Conditions govern your use of our website bugginmadeira.com and the booking of our buggy tours. By accessing the site or using our services, you agree to be bound by these Terms.

2. Eligibility

Participants must meet the minimum age requirement (18 years or as indicated for each vehicle type).
A valid car driving licence (category B) is required.
Participants must be in good health and not under the influence of alcohol, drugs or other substances that impair their abilities.

3. Booking and payment

All bookings must be made through our website or authorised partners.
A deposit or full payment may be required to confirm the booking.
Full payment must be made before the tour starts; when booking via the website, payment may be agreed for the day of the activity.
Cancellations must be made within the specified period to be eligible for a refund (see Cancellation Policy below).

4. Cancellations and refunds

Cancellations made at least 24 hours before the tour are entitled to a full refund.
No refund will be given for no-shows or last-minute cancellations.
We reserve the right to cancel a booking due to adverse weather, safety reasons or other unforeseen circumstances. In such cases, a full refund or rescheduling will be offered.

5. Safety and liability

All participants must use the safety equipment provided (helmet, gloves, etc.).
A briefing and/or training session will be held before the activity.
Participants are fully responsible for damage to vehicles caused by negligent, reckless driving or breach of safety rules.
We are not liable for injury, damage or loss resulting from the use of our services, except where caused by our negligence.

6. Conduct and responsibility

Participants must follow the designated routes and comply with the guide’s instructions.
Reckless behaviour, including speeding or driving off the route, may result in immediate termination of the activity with no refund.
Participants are responsible for any fines, penalties or damage caused by failure to comply with applicable traffic laws.

7. Insurance and damage

We may optionally offer insurance or damage cover at an additional cost.
In the event of damage to the vehicle, the participant may be liable for repair costs unless covered by insurance or a contracted plan.

8. Privacy policy

Personal data collected during booking is processed in accordance with our Privacy Policy. We do not share your data with third parties except where necessary to provide the service.

9. Changes to the terms

We reserve the right to update or modify these Terms at any time. The latest version will always be available on our website. Continued use of the site after changes constitutes acceptance of the new terms.

10. Governing law

These Terms are governed by and construed in accordance with the laws of Portugal. Any dispute shall be resolved in the Portuguese courts.
